This Privacy Policy describes how ComposerSync, LLC (“ComposerSync,” “we,” “us,” or “our”) collects, uses, stores, and shares information about you when you use our website and services at composersync.biz (the “Service”). By using the Service, you agree to the practices described in this Privacy Policy.

1. Information We Collect

1.1 Information You Provide

We collect information you provide directly when you:

• Create an account (name, email address, password)
• Upload audio files to the Service
• Subscribe to a paid plan (billing details handled by our third-party payment processor)
• Contact us for support or communicate with us by email
• Subscribe to our marketing emails or newsletters
• Submit a creative brief or prompt to SyncRecommender for AI-generated composition ideas
• Create or participate in a SyncSession
• Provide feedback, including rating a SyncRecommender or SyncSession result or a suggested chord progression, or sending a message through the in-app Feedback tab

1.2 Information Collected Automatically

When you use the Service, we automatically collect certain technical information, including:

• IP address and approximate location
• Browser type and operating system
• Pages visited and features used within the Service
• Date and time of access
• Referring URLs
• Device identifiers
• Feature usage counts for your subscription tier (for example, the number of SyncRecommender briefs, SyncSession sessions, or SyncTag uploads used in a given trial period or billing month), which we use solely to enforce and display your plan's usage limits

1.3 Audio Files and Metadata

When you upload audio files to ComposerSync, we store those files in secure cloud storage and process them using AI and machine learning technology to generate metadata. The metadata generated includes information such as genre, BPM, key, instrumentation, mood, and sync placement suggestions.

1.4 Composing Suite Content and Quality Review

When you use SyncRecommender or SyncSession, we process the creative brief, prompt, or other material you submit using a third-party AI model (currently Google's Gemini API, accessed through a proxy service we operate) in order to generate composition ideas and related suggestions. We send these requests under the Gemini API's paid-tier billing; per Google's own terms of service, prompts and responses sent under paid-tier billing are not used to improve Google's products. You can review Google's current terms directly at https://ai.google.dev/gemini-api/terms for the specifics of how Google itself handles this data — we encourage you to check that page, since Google's policies are outside our control and may change.

We retain the brief or prompt you submitted, the composition ideas or suggestions we generated in response, and any feedback you provide about those results, together in your account. We use this combined information — the request, the result, and your feedback on it — to evaluate whether SyncRecommender and SyncSession are producing good results and to improve the quality of future results. This review is a standard part of how the composing suite operates for all users and is not something you can individually opt out of while continuing to use these features; you can decline to provide feedback, but the brief, prompt, and generated results themselves are still retained and may be reviewed for this purpose. Messages sent through the Feedback tab are stored with your account and also emailed to our support inbox (see Section 4).

Ideas and suggestions generated for you are stored in your account so you can retrieve them later, in the same way your uploaded audio files are stored.

1.5 Payment Information

We use a third-party payment processor to handle all payment transactions. We do not collect, store, or have access to your credit card number, bank account information, or other sensitive financial details. Our payment processor's collection and use of your payment information is governed by their own privacy policy.

2. How We Use Your Information

We use the information we collect to:

• Create and manage your account
• Provide, operate, and improve the Service
• Process your audio files and generate AI metadata analysis
• Process your composing-suite submissions and generate AI-assisted composition ideas and sync suggestions
• Review composing-suite sessions together with any feedback you provide, in order to evaluate result quality and improve future results (see Section 1.4)
• Track and enforce the usage limits associated with your subscription tier (Free trial, Starter, or Pro), and show you your current usage
• Process payments and manage your subscription
• Send you transactional emails such as account confirmations, receipts, and service notifications
• Send you marketing emails and newsletters about ComposerSync features, updates, and offers (you may opt out at any time)
• Respond to your support requests and inquiries
• Monitor and analyze usage and trends to improve the Service
• Detect, prevent, and address technical issues, fraud, or security breaches
• Comply with legal obligations

3. How We Share Your Information

We do not sell your personal information. We may share your information in the following limited circumstances:

3.1 Service Providers

We share information with third-party service providers who assist us in operating the Service. These providers are contractually obligated to protect your information and may only use it to provide services on our behalf. Our current service providers include:

• Cloud storage providers (for storing your uploaded audio files)
• AI and machine learning providers (for metadata analysis and for composing-suite idea generation, currently including Google's Gemini API)
• Payment processors (for handling subscription billing)
• Email service providers (for transactional and marketing emails, and for delivering feedback you submit to our support inbox)
• Infrastructure providers that operate a proxy layer between the Service and our AI provider, for security and authorization purposes

3.2 Analytics

We use analytics tools, including Google Analytics, to help us understand how users interact with the Service. Google Analytics may collect information such as how often you visit the Service, what pages you visit, and what other sites you visited prior to visiting us. We use this information to improve the Service. Google's privacy policy is available at https://policies.google.com/privacy.

You can opt out of Google Analytics by installing the Google Analytics opt-out browser add-on available at https://tools.google.com/dlpage/gaoptout.

3.3 Legal Requirements

We may disclose your information if required to do so by law or in the good faith belief that such disclosure is necessary to comply with a legal obligation, protect and defend our rights or property, prevent fraud, or protect the safety of our users or the public.

3.4 Business Transfers

If ComposerSync is involved in a merger, acquisition, or sale of all or a portion of its assets, your information may be transferred as part of that transaction. We will notify you of any such change via email or prominent notice on our website.

4. Data Retention

We retain your personal information and uploaded files for as long as your account is active or as needed to provide the Service.

If you close your account, we deactivate it so you can no longer sign in. After deactivation, your account information, uploaded files, and composing-suite content (including briefs, generated results, session records, and any feedback you provided) remain stored in our systems and linked to your account unless you ask us to delete them. To request deletion, email privacy@composersync.biz. We will delete or anonymize your personal information within 30 days of verifying your request, except where we are required to retain it for legal or compliance purposes.

We may keep information that has been anonymized so that it can no longer be linked to you, including for service improvement. Feedback you write may contain personal information, so please avoid including details you do not want us to keep. Copies of feedback messages are also sent to our support email inbox and may be retained there.

5. Data Security

We implement industry-standard technical and organizational measures to protect your information against unauthorized access, alteration, disclosure, or destruction. These measures include encrypted data transmission, secure cloud storage, and access controls. Requests to our AI provider are authorized through a shared-secret proxy layer so that composing-suite processing cannot be accessed directly by unauthenticated parties.

However, no method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your information, we cannot guarantee its absolute security.

6. Your Rights and Choices

6.1 Account Information

You may review and update your account information at any time by logging into your account settings. You can close your account from your profile page; closing it deactivates your account as described in Section 4. To have your account information and content deleted, contact us at privacy@composersync.biz.

6.2 Marketing Communications

You may opt out of receiving marketing emails from us at any time by clicking the unsubscribe link in any marketing email or by contacting us at privacy@composersync.biz. Please note that even if you opt out of marketing communications, we may still send you transactional emails related to your account and the Service.

6.3 Analytics Opt-Out

You may opt out of Google Analytics data collection as described in Section 3.2 above.

6.4 Do Not Track

Some browsers offer a Do Not Track (DNT) setting. Our Service does not currently respond to DNT signals.

6.5 California Residents

If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we collect, the right to request deletion of your personal information (see Section 4), and the right to opt out of the sale of your personal information. 7. Children's Privacy

The Service is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If we become aware that we have collected personal information from a child under 13, we will take steps to delete that information promptly.

8. Third-Party Links

The Service may contain links to third-party websites or services. We are not responsible for the privacy practices of those third parties, and we encourage you to review their privacy policies before providing any information to them.

9. International Users

ComposerSync is operated in the United States. If you are accessing the Service from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States where our servers are located. By using the Service, you consent to the transfer of your information to the United States.

10. Free Trial and Subscription Tiers

ComposerSync offers a 30-day free trial period beginning when you create your account. During and after the trial, your use of certain features (including SyncRecommender, SyncSession, and SyncTag) is subject to usage limits that vary based on whether you are on the Free, Starter, or Pro tier, as described on our Pricing page. We retain the feature-usage information described in Sections 1.2 and 2 above for as long as needed to enforce these limits and are transparent with you about your current usage inside the Service.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any material changes by posting the updated policy on our website and, where appropriate, by sending you an email notification. Your continued use of the Service after any changes become effective constitutes your acceptance of the revised Privacy Policy.

We encourage you to review this Privacy Policy periodically to stay informed about how we protect your information.
